THE STATE OF UTAH TO ALL PERSONS INTERESTED IN THE FOLLOWING MATTER:

NOTICE IS HEREBY GIVEN that the Board of Oil, Gas and Mining
("Board"), State of Utah, will conduct a hearing on WEDNESDAY, JANUARY
23, 2013, at 9:00 AM, or as soon thereafter as possible, in the
auditorium of the Department of Natural Resources, 1594 West North
Temple, Salt Lake City, Utah.

DOCKET NO. 2010-026 CAUSE NO. C/015/0032F - In The Matter of the
Request for Agency Action of Genwal Resources, Inc., Petitioner and
Permittee; Division of Oil, Gas and Mining, Respondent - Request for
Board Review of Division Order DO10A, Requiring Bonding for the
Perpetual Treatment of Mine water discharge at the Crandall Canyon
Mine in Emery County, Utah.

The Board issued its Findings of Fact, Conclusions of Law and Order
in the above-captioned matter on March 6, 2012. In paragraph 3 (page

monitoring data be reviewed at least annually, or with such greater
frequency as the Division deemed appropriate. The Board further
requested that such data be presented to the Board should either party
desire that the Board analyze a potential bond adjustment or other
modification of the Order.

Ten months have passed since the Order was issued, and the iron
concentration data presented to the Board is now more than a year old.
The Board seeks an update on the status of the iron concentrations at
issue in this matter and direct the parties to appear at the Board's
next scheduled hearing (on January 23, 2012, at 9:00 AM, in the
auditorium of the Department of Natural Resources, 1594 West North
Temple, Salt Lake City, Utah) to present the most recent iron
concentration data available (including, if possible, the data for
December of 2012).

The hearing will be conducted as a formal administrative adjudication
in accordance with the rules of the Board as set forth in Utah
Administrative Code R641 et seq. and as provided for in Utah Code Ann.
§ 40-6-1 et seq. and Utah Code Ann. § 63G-4-101 through 601.

Pursuant to the Americans with Disabilities Act, persons requiring
auxiliary communicative aids and services to enable them to
participate in this hearing should call Julie Ann Carter at (801)
