   NOTICE OF INTENTION TO ANNEX CERTAIN PROPERTY INTO THE
CASTLE VALLEY SPECIAL SERVICE DISTRICT, UTAH

	NOTICE is hereby given to all interested persons that on November 27,
2012, the Board of County Commissioners (the "Commission") of Emery
County, Utah adopted a resolution declaring intention to annex certain
property into the boundaries and service area of the Castle Valley
Special Service District, Utah (the "District"), and providing for the
holding of a public hearing on the proposed annexation of property
into the District. The District's boundaries consist of the
incorporated communities within the County, including Castle Dale
City, Clawson Town, Cleveland Town, Elmo Town, Emery Town, Ferron
City, Huntington City, and Orangeville City.  These named communities
have annexed certain properties into their municipal boundaries and
the District desires to amend its boundaries to conform to the
boundaries of the incorporated communities.

	The boundaries and service area of the proposed annexation into the
District shall include property located in Emery County, Utah and
described as follows:

EMERY TOWN
T.22 S. R.6 E.

SECTION 4 (December 2002)
	Beginning at a point which is 100.00 feet South of the Northeast
corner of the Northeast quarter of the Southwest quarter of Section 4,
Township 22 South, Range 6 East, Salt Lake Meridian, Utah, said point
being on the existing Castle Valley Special Service District Boundary;
thence South, 164.31 feet along said boundary; thence West, 31.50 feet
along said boundary; thence N 25°55'40" W, 293.89 feet along said
boundary; thence West, 335.00 feet along said boundary; thence South,
660.00 feet along said boundary; thence East, 495.00 feet; thence
South, 165.00 feet to said boundary; thence South, 165.00 feet along

Northwest quarter of Section 9, Township 22 South, Range 6 East, Salt
Lake Meridian, Utah, thence North, 330.00 feet to the existing Castle
Valley Special Service District Boundary; thence East, 660.00 feet
along said boundary; thence South, 330.00 feet along said boundary;
thence West, 660.00 feet to the point of beginning.
	Containing 5.00 acres, more or less.

FERRON CITY

SECTION 10 (Ferron Cemetery)
	Beginning at a point which is 10.00 feet West and 449.22 feet South
of the Center of Section 10, Township 20 South, Range 7 East, SLB&M,
said point being on the existing Castle Valley Special Service
District Boundary; thence South, 104.28 feet along said boundary;
thence East, 63.50 feet along said boundary; thence South, 445.50 feet
along said boundary; thence West, 63.50 feet along said boundary;
thence South, 23.18 feet along said boundary to the south line of
Ferron City property; thence East, 305.81 feet along said line to the
southeast corner of said Ferron City property; thence North, 272.85
feet along the east line of said Ferron City property to a property
corner; thence N 45°34'57" W, 428.47 feet along the northeasterly

	Beginning at a point which is 131.66 feet East of the Southwest
corner of the Southeast quarter of the Northwest quarter of Section
11, Township 20 South, Range 7 East, SLB&M, said point being on the
existing Castle Valley Special Service District Boundary; thence
North, 125.00 feet along said district boundary; thence East, 384.84

of beginning.

	Beginning at a point which is S 00°20'12" E, 500 feet and N
89°22'10" E, 160 feet from the Northwest corner of Section 15,
Township 20 South, Range 7 East, Salt Lake Meridian, Utah, said point
being on the existing Castle Valley Special Service District Boundary;

Section 15, said point of beginning also being located on the Castle
Valley Special Service District Boundary; thence N 89°21'41" E

919.50 feet from the Northeast corner of the Northwest quarter of said
Section 15, said point of beginning also being located on the existing
boundary of the Castle Valley Special Service District; thence N

	No additional services are to be provided by the District.  The
services the District has previously provided shall be provided to the
property proposed for annexation

	The public hearing shall be held on January 22, 2013, at 10:00 a.m.
at the Emery County Courthouse at 75 East Main in Castle Dale, Utah. 
Any interested person may protest the proposed annexation either
orally at said public hearing, or in a written protest filed with the
Emery County Clerk/Auditor.  All written protests must be filed within
15 days after the conclusion of said public hearing and all
withdrawals or cancellations of withdrawals must be filed within 30
days after the conclusion of said public hearing.  The Commission will
hear all interested persons desiring to be heard and will give full
consideration to all protests.  If special accommodations are
required, please call (435) 381-5106 with reasonable advance notice.

	Any written protest made on behalf of a corporation owning property
within the proposed annexation area shall be signed by the president,
vice president, or any duly authorized agent of the corporation. 
Where property within the proposed annexation area is owned by more
than one person or entity, all owners holding title to the property
must join in the signing of the protest in order for it to be
considered in the thirty three percent (33%) calculation discussed
below.

	If, within the designated protest period, more than thirty three
percent (33%) of the qualified voters of the territory proposed to be
annexed into the District, or the owners of over thirty three percent
(33%) of the taxable value of the taxable property proposed to be
annexed into the District, file written protests against the proposed
annexation of their property, the Commission is required by law to
abandon the proposed annexation of that property.  Taxes may be
annually levied upon all taxable property within District and fees and
charges may be imposed to pay for all or part of the services to be
provided.

	After the public hearing and protest period closes, the County
Commission shall adopt a resolution either carrying out the proposed
annexation or abandoning the proposed annexation.  A resolution
approving the annexation may contain any changes from the initial
resolution or this notice of intention that the Commission determines
to be appropriate, including reduction of boundaries of the proposed
annexation area. The boundaries of the proposed annexation area may
not be increased unless the Commission gives a new notice of intention
and holds a new public hearing.

	Any person who shall have timely filed a written protest and who is a
qualified voter residing within, or owning property within, the
District, may petition the district court within 30 days after the
adoption of said annexation resolution for a writ of review.  The
grounds for such a petition are limited to: (1) a claim that the
petitioner's property will not be benefited by the services to be
provided by the District; and (2) a claim that the procedures used to
establish the District violated the law.

	FAILURE TO TIMELY FILE A WRITTEN PROTEST PRECLUDES THE PROTEST FROM
BEING INCLUDED IN THE 33% CALCULATION DISCUSSED ABOVE AND THE
PROTESTANT FROM FILING A PETITION FOR A WRIT OF REVIEW.  FAILURE TO
TIMELY FILE A PETITION FOR WRIT OF REVIEW FORECLOSES ANY RIGHTS TO
THEREAFTER OBJECT TO THE ESTABLISHMENT OF THE DISTRICT.
