PUBLIC NOTICE OF RENEWAL OF A 
UPDES PERMIT

PURPOSE OF PUBLIC NOTICE

	THE PURPOSE OF THIS PUBLIC NOTICE IS TO DECLARE THE STATE OF UTAH'S
INTENTION TO REISSUE A UTAH POLLUTANT DISCHARGE ELIMINATION SYSTEM
(UPDES) PERMIT UNDER AUTHORITY OF THE UTAH WATER QUALITY ACT, SECTION
19-5-106 AND 107, UTAH CODE ANNOTATED 1953, AS AMENDED.  SAID "PERMIT"
REFERS TO UPDES PERMIT AND THE STATEMENT OF BASIS (INCLUDING THE TOTAL
MAXIMUM DAILY LOADS (TMDL'S)) IF APPLICABLE, AS PER SECTION 303 (d) OF
THE FEDERAL CLEAN WATER ACT (CWA).

PERMITTEE NAME:	Energy West Mining Company, Trail Mountain Mine

FACILITY LOCATION:	Approximately twelve miles northwest of 
	Orangeville, Utah in Emery County, near the 
	Cottonwood/Wilberg Mine
UPDES PERMIT NO.:	UT0023728
PERMITTED OUTFALLS	001, 002  
RECEIVING WATER:	Cottonwood Canyon Creek thence Cottonwood \		Creek

BACKGROUND
	Energy West Mining Company (a subsidiary of PacifiCorp) Trail
Mountain Mine is an underground coal mining operation which ceased
operation in 2001.  The portals have been sealed and there has been no
mining activity since that time. None of the Outfalls have discharged
nor are presently discharging.  It is not know exactly when the mine
will resume operation, but a permit is necessary in case the mine does
begin operation in the next five years.

PUBLIC COMMENTS
	Public comments are invited any time prior to the deadline of the
close of business on March 20, 2014.   Written public comments can be
submitted to:  Mike Herkimer, UPDES Engineering Section, Utah 
Division of Water Quality, P.O. Box 144870, Salt Lake City, Utah
84114-4870 or by email at: mherkimer@utah.gov.  After considering
public comment, the Division of Water Quality may reissue, revise, or
abandon this permit. The permit is available for public review under
"Public Participation" at www.waterquality.utah.gov.  If internet
access is not available, a copy may be obtained by calling Mike
Herkimer at 801-536-4386.
