Notice of sale of C. W. Mining Company assets, free and clear of liens, claims, interests and encumbrances

On May 21, 2010, at 9:00 a.m., local time, The Honorable R. Kimball
Mosier, United States Bankruptcy Judge for the District of Utah, at
the United States Courthouse, 350 South Main Street, Salt Lake City,
Utah, will hold a hearing regarding the proposed sale of mining assets
and the assumption and assignment of mine operating agreements of C.
W. Mining Company, d/b/a Co-Op Mining Company, in the Chapter 7
proceeding styled, In Re C. W. Mining Company d/b/a Co-Op Mining
Company, Bankruptcy Case No. 08-20105-RKM.  Kenneth A. Rushton,
Chapter 7 Trustee, for C. W. Mining Company d/b/a Co-Op Mining
Company, has requested that the Court approve the sale to Rhino Energy
LLC, or one of its affiliates, of mining assets of the bankruptcy
estate including, but not limited to the following:  (1) Coal
Operating Agreement with C.O.P. Coal Development Company; (2) Coal
Operating Agreement with ANR Company, Inc.; (3)  equipment and other
assets; (4) all underground facilities and infrastructure; (5) all
surface facilities and infrastructure; (6) application for a logical
mining unit; (7) parts and supplies on hand; (8) permit to operate the
mine from the Utah Division of Oil, Gas and Mining and other
transferrable permits; (9) any appurtenant water rights; (10)
technical data; (11) environmental and monitoring reports and data;
(12) operational computers; (13) mine fans, conveyors, pumps and other
infrastructure; (14) keys to buildings and equipment; (15) any other
hard assets related to the operation of mine (collectively, the

	The sale of the Assets shall be free and clear of all liens, claims,
interests and encumbrances, including, without limitation, any claims
of successor liability.  The Court documents describing the proposed
transaction in more detail are available from the Bankruptcy Clerk at
the above address.  

	Any objections must be filed with the Bankruptcy Court and served on
(1) counsel for the Trustee, Prince Yeates and Geldzahler, City Center
I, Suite 900, 175 East 400 South, Salt Lake City, Utah 84111-2357,
Attention:  Michael N. Zundel, and (2) counsel for the buyer, Jackson
Kelly PLLC, 500 Lee Street East, Suite 1600, Post Office Box 553,
Charleston, West Virginia  25322-0553, Attention:  William F. Dobbs,
Jr., and Parsons Kinghorn Harris, 111 East Broadway, 11th Floor, Salt
Lake City, Utah 84111, Attention:  George B. Hofmann, so as to be
received by 5:00 p.m., local time, on May 17,  2010.
