Mayor Neal Peacock opened the Castle Dale meeting with a pledge of allegiance to the flag of the United States.
The Mayor then announced a public hearing to consider the Castle Dale City Ordinance relating to the sale and use of fireworks in the city. This ordinance will replace the prior ordinance.
Fire Chief Richard Herring appeared before the city council and reported the changes in state law made by the state Legislature this year. The state Legislature decided instead of having three days of shooting fireworks and 20 days of sales, the law would allow fireworks to be sold and fired from June 26 through July 26, also Dec. 31 and Jan. 1. Fireworks may be shot into the air as high as they want but the fireworks are required to come back to earth cold.
However the fireworks sold and fired, will have to comply with those fireworks approved by the State Fire Marshal. Chief Herring expects this new fireworks law will mean that fire departments are going to have a lot more fire fighting to do this summer.
Mayor Peacock said, "The city council had no choice they have to comply with state law and pass the ordinance."
Mark H. Williams presented to the city council his proposal to annex land south and east of the Castle Dale City known as the Sewerville Annexation. Williams presented a plat map showing the 1.87 acre boundaries for the annexation. He had been before Castle Dale City Planning and Zoning, they and the city council accepted the petition for the annexation provided Williams supplies a copy of the plat map to the county clerk, pays the $80 fee for advertising the annexation public hearing. If at the July meeting the annexation is approved, the annexation will then go to the county clerk, to the Lt. Governors office and finally to the tax commission. A plat map is available at the Castle Dale City Hall.
Mayor Peacock said the City needs a quit claim deed for the property that will become a city street from Williams. Williams said the deed is already made out. The annexation will affect property owned by Williams and Don James Huggard. The July city council meeting will include the public hearing to consider approving this annexation.
Gilbert Lamb appeared before the city council requesting his Castle Dale property be rezoned from R1-8000 to central commercial as he has a buyer for his property and the buyer intends to turn Lamb's house into an office for his gas well business. The question before the city council was should the small triangle city park on the corner east of and adjoining Lamb's property be rezoned in order to avoid spot zoning. Castle Dale City owns the park. This proposal for rezoning has gone before Castle Dale City Planning and Zoning. Planning and zoning felt that it would not be spot zoning if the park was included and also zoned central commercial. Lamb's request to the city council was to include the park in changing his land to central commercial zoned property. The city council decided to include the park in the change of zoning request. Lamb will have to pay $80 to advertise the request for rezoning and if approved the recording fee. A public hearing will be held in July concerning the annexation of this property.
Allison Cox from the Travel Council Regional Information Center reported that she is a recent employee of the travel council. The information center is a place for visitors and local residents to come and find out what is going on in the communities. That information is only possible through the contributions of partners such as Castle Dale City.
Cox came to inquire about Castle Dale's continuing partnership and a financial contribution. She said she would be happy to promote any events that are going on in Castle Dale.
Mayor Peacock stated that in the past they have given $250 to the continuing partnership with the Castle Country Regional Information Center. He also said they have gotten our money's worth with what we have done in the past.
The council approved the continued support of the Castle Country Regional Information Center by giving them $250.
Kerry Lake's Planning and Zoning report indicated the city needs to update their land use manual regarding subdivisions.
Chief Herring reported on the fire department and ordinance enforcement. They have a fire truck that has a cracked head and a decision needs to made about repairing the truck or including it in the county auction.
Linda Turner discussed the repair of broken headstones in the cemetery. Mayor Peacock reported the LDS Church is looking for service projects for the youth. He suggested they could possibly be used to clean and repair headstones. The city would pay for the repair materials.
The meeting was adjourned to go into a budget meeting for the 2011-2012 budgets.
