PURPOSE OF PUBLIC NOTICE
THE PURPOSE OF THIS PUBLIC NOTICE IS TO DECLARE THE STATE OF UTAH'S
INTENTION TO RENEW A UTAH POLLUTANT DISCHARGE ELIMINATION SYSTEM
(UPDES) PERMIT UNDER AUTHORITY OF THE UTAH WATER QUALITY ACT, SECTION
19-5-104 AND 107, UTAH CODE ANNOTATED 1953, AS AMENDED. SAID "PERMIT"
REFERS TO UPDES PERMIT AND THE STATEMENT OF BASIS (INCLUDING THE TOTAL
MAXIMUM DAILY LOADS (TMDL'S)) IF APPLICABLE, AS PER SECTION 303 (d) OF
THE FEDERAL CLEAN WATER ACT (CWA).

BACKGROUND
Consolidation Coal Company (Consol) owns and operates an underground
coal mine located 4 miles south of the town of Emery in Emery County,
Utah, Township 22 South, Range 6 East. In addition to the mine, Consol
has a small blending plant to size the coal and a truck loading area
at the facility. The mine is currently idle, however, in order to keep
the mine viable, Consol must continue to dewater the mine. Consol has
been continually pumping and discharging intercepted groundwater from
the mine since the early 1980's.Consol is authorized to discharge
intercepted groundwater and storm water from Outfalls 001, 002, 003,
004, 005, 006, 007, 008 and 009 to Quitchupah Creek, a tributary of
Muddy Creek.
PUBLIC COMMENTS
Public comments are invited any time prior to the deadline of the
close of business on May 31, 2012. Written public comments can be
submitted to: Kim Shelley, UPDES Engineering Section, Utah Division
of Water Quality, P.O. Box 144870, Salt Lake City, Utah 84114-4870 or
by email at: Kshelley@utah.gov. After considering public comment the
Utah Water Quality Board may execute the permit renewal, revise it, or
abandon it.

Participation" at www.waterquality.utah.gov/. If internet access is
