NOTICE OF SUBSTITUTE TRUSTEE'S SALE
The following described property will be sold at public auction to
the highest bidder payable in lawful money of the United States at the
time of sale at the front door of the Emery County Seventh District
Justice Courthouse, 80 Farrer Street, Green River, Utah in Emery
County, Utah, on July 2, 2013 at 11:00 a.m of said day, for the
purpose of foreclosing a Trust Deed originally executed by Curtis R.
Daw and Irene R. Daw as Trustors and Dusten L. Heugly, Trustee, in
favor of Harold Potter as beneficiary, which Trust Deed was recorded
September 1, 2006, Page 1 thru 7, as Entry No. 375259, in the office
of the Recorder of Emery County, Utah, covering real property located
at or about 610 So. Green River Blvd, Green River, Emery County, Utah
84525 (the undersigned disclaims liability for any error in the
address) and more particularly described as follows:
Parcel: Tax Id#1-154B-0038
A tract of land being and comprising portions of Tracts 6, 9, 11, 12
and all of Tract 10, ORCHARD HOME DIVISION, of the City of Green
River, Utah, within Emery County, Utah, as the same are shown and
designated on the plat of said City, dated June 1928, and said tract
of land being more particularly described as follows: BEGINNING at
the Northwest corner of the herein described tract of land, from
whence the Northwest Corner of the above said Tract 6 bears South
89Â°34'13" West. 170.00 feet distant, and running thence from said
point of beginning North 89Â°34'13" East. 387.00 feet to the
Northeast Corner of the herein described tract of land, and the
Northeast Corner of the above said Tract 6 and running thence South
0Â°25'47" East 272.81 feet to the common Corner of Tracts 6, 7, 9,
and 10, and running thence North 89Â°34'13" East 497.00 feet to the
Northeast Corner of the above said Tract 10 and a point of the
Westerly right-of-way line of Park Avenue, and running thence along
said Westerly right-of-way line South 0Â°25'47" East 629.42 feet to
the Southeast Corner of the herein described tract of land, thence
leaving said Westerly right-of-way and running thence South
87Â°13'23" West 189.17 feet to a point, and running thence North
5Â°31'43" West 201.68 feet to a point, and running thence North
56Â°14'33" West 263.46 feet to a point, and running thence South
87Â°45'19" West 519.54 feet to the Southwest Corner of the herein
described tract of land, and running thence North 6Â°52'40" East
299.95 feet to a point, and running thence East 22 feet and running
thence North 280 feet to the Northwest Corner of the herein described
tract of land, and the point of beginning.
Bearing Ref. And Corner Desc. All bearings referred to North-South
Quarter line of the Section16, Township 12 South, Range 16 East, Salt
Lake Base and Meridian, as being North 0Â°04' West Long Street).
Situate in Emery County, State of Utah
TOGETHER with all buildings, fixtures and improvements thereon and all
water rights, rights of way, easements, rents, issues, profits,
income, tenements, hereditaments, privileges and appurtenances
thereunto belonging, now or hereafter used or enjoyed with said
property, or any part thereof; SUBJECT, HOWEVER, to the right, power
and authority hereinafter given to and conferred upon Beneficiary to
collect and apply such rents, issues, and profits.
The current beneficiary of the Trust Deed is Harold Potter, and the
record owner(s) of the property as of the recording of the Notice of
Default is Curtis R. Daw and Irene R. Daw.
TOGETHER with all the improvements now or hereafter erected on the
property, and all easements, rights, appurtenances, rents, royalties,
mineral, oil and gas rights and profits, water, water rights and water
stock, and all fixtures now or hereafter attached to the property, all
as further described in said Trust Deed, without warranty as to title.
The sale is subject to a bankruptcy filing, a payoff, a reinstatement
or any other condition of which the trustee is not aware that would
cause the cancellation of the sale. If any such condition exists, the
sale shall be void, the successful bidder's funds returned and the
trustee and current beneficiary shall not be liable to the successful
bidder for any damage.
The purchase price is payable in lawful money of the United States of
America. Bidders must be prepared to tender to the Trustee a
$5,000.00 non-refundable deposit in certified funds or a cashier's
check at the time of sale to secure bid, and the balance of the
purchase price must be paid in full in the form of certified funds or
a cashier's check within 24 hours from the time of sale.
This Communication is an attempt to collect a debt, and any
information obtained will be used for that purpose.
