Notice of Sale

    
Pursuant to a Writ of Execution of the Seventh District Court in and
for Carbon County, case no. 090700187, the Sheriff of Emery County
shall sell to the highest bidder all of  Richard D. Vanwagoner's
interest in and to the following described real property located in
Emery County:

Date: Wednesday, February 3, 2010

Time: 10:00 a.m.

Place: Emery County Courthouse, 1850 North 560 West, Castle Dale, Utah
84513

	Beginning at the Northwest Corner of the Northeast Quarter of the
Northwest Quarter of Section 19, Township 17 South, Range 9 East,
SLB&M, and running thence East 77 Rods; thence South 23.5 Rods; thence
Southwesterly 47 Rods; thence West 48 Rods; thence North 60 Rods to
the point of beginning. 
	*Less said lands deeded to Ernesto Ibanez and Carolyn Ibenez in the
Warranty Deed recorded September 26, 1995 in Book 218 at Page 88,
described as follows:
	Beginning 3 Rods West of the Northeast Corner of the Northeast
Quarter of the Northwest Quarter of Section 19, Township 17 South,
Range 9 East, SLB&M: Being on the West Boundary of the County Road
right-of-way; thence South 220 feet, thence West 200 feet; thence
North 220 feet; thence East 200 feet to the point of beginning. 
	*Also Less any lands deeded to Ernesto Ibanez and Carolyn Ibanez in
the Warranty Deed recorded October 4, 2001 in Book 279 at Page 661,
described as follows:
	Beginning 3 Rods West and 220 feet South of the Northeast Corner of
the Northeast Quarter of the Northwest Quarter of Section 19, Township
17 South, Range 9 East, SLB&M, said point being on the West boundary
of  County Road right-of-way; thence West 200 feet; thence South 250
feet; thence East 200 feet, more or less to the County Road
right-of-way; thence Northerly along said county road right-of-way to
the point of beginning. 
	*Also less any portion that may lie within the County Road.

	The owners of record are Richard D. Vanwagoner and Tricia D.
Vanwagoner
Bidders must be prepared to tender to the EMERY COUNTY SHERIFF
$2,000.00 at the sale and the balance of the purchase within 24 hours
deliverable to the EMERY COUNTY SHERIFF. Both payments must be in the
form of cashier's check or money order and made payable to EMERY
COUNTY SHERIFF.
