Notice Of Trustee'S Sale
The property described below will be sold at public auction to the
highest bidder. The sale will be held at the main entrance of the
Emery County District Court located at 560 West 1850 North,
Castledale, UT 84513, on May 21, 2010, at 1:00 p.m. (MST). The
purpose of the sale is the foreclosure of that certain Deed of Trust,
dated September 8, 2008 ("Deed of Trust"), granted by Ecodomaine
Refining, inc. (as "Borrower" and "Trustor"), in favor of Private
Capital Group as agent for those individuals/entities listed on the
exhibit "A" of the Deed of Trust, and Douglas J. Shumway, an active
member of the Utah State Bar residing in Provo, Utah, as ("Successor
Trustee"). The Deed of Trust was recorded on September 9, 2008, as
Entry No. 391995 in the Official Records of the County Recorder of
Emery County, State of Utah. The property subject to the Deed of
Trust is situated in Emery County, State of Utah, and is more
particularly described as follows:
Legal Description: The Northeast quarter of the Southeast quarter,
Section 13, Township 21 South, Range 16 East, Salt Lake Base and
Meridian. Less the West 30 feet of the said Northeast quarter of the
Southeast quarter, the Denver and Rio Grande Western Railroad
right-of-way within said Northeast quarter of the Southeast quarter of
Section 13, and the right-of-way of U.S. Highway 50 and 6 within said
Northeast quarter of the Southeast quarter.
Tax ID No. 01-153B-0003 (the "Trust Property")
The Notice of Default and Election to sell ("Notice of Default") for
the Deed of Trust was recorded on January 11, 2010, as Entry No.
396333 in the Official Records of the County Recorder of Emery County,
State of Utah.
The current beneficiary of the Deed of Trust is Private Capital
Group, Inc. as agent for those individuals/entities listed on the
Exhibit "A" of the deed of trust, ("Beneficiary"), whose mailing
address is c/o Private Capital Group, 160 W. Canyon Crest Road,
Alpine, UT 84004, and the record owner as of the recording of the
Notice of Default is Ecodomaine Refining, LLC, whose principal place
of business is 2700 Rasmussen Road, Park City, UT 84098.
The purchase price is payable in lawful money of the United States at
the time of sale. Bidders must tender to the successor trustee a
$5,000.00 deposit at the sale and, at the address provided below, the
balance of the purchase price no later than 2:00 p.m. (MST) on the
next business day following the sale. The deposit and payment must be
in the form of a cashier's check and bank "Official Checks" are not
acceptable. A trustee's deed will be made available to the successful
bidder within three (3) business days following receipt of the bid
amount. The Trust Property is to be sold without any warranties
whatsoever, including, but not limited to, any warranties of title,
possession, or encumbrances. For further information about the sale
please contact the Successor Trustee. The purpose of this Notice of
Trustee's Sale is to collect a debt and any information obtained may
be used for that purpose.
